WASHINGTON, D.C. – Today, as part of its initiative under the Center for Legal Equality, America First Legal (AFL) asked the U.S. Equal Employment Opportunity Commission (EEOC) to open a civil rights investigation of The Hershey Company for engaging in unlawful, discriminatory hiring practices.

Following on past AFL activity regarding illegal activities taken by other woke corporations like AmazonStarbucksDicks Sporting GoodsLyft, and others, today AFL sent a letter to the EEOC asking it to open a federal employment discrimination investigation into The Hershey Company.

Earlier this month, Hershey’s announced it was “Bringing back its empowering, limited-edition Hershey’s SHE bars.” Ironically, the ad campaign prominently featured a biological male masquerading as a woman, as the face of female empowerment. A closer look reveals Hershey’s obsession with gender and race goes much further and crosses the line into illegal activity.

For at least the past two years, Hershey’s has been engaging in illegal race and sex discrimination in its hiring and promotion practices. Hershey’s brags in its press releases and its ESG Report about hitting quotas and benchmarks, which it can only do by taking into account and making decisions based on a person’s race or sex.

Hershey also has a “GROW” program, available only to members of certain races.

Accordingly, AFL has asked the EEOC to do its job, investigate Hershey’s employment practices, and take appropriate action based on its investigation.

Statement from Gene Hamilton, America First Legal Vice President and General Counsel:

“Congress made the correct decision decades ago to prohibit companies from discriminating against American citizens because of immutable characteristics like race and sex. But in recent years, it’s become apparent that a generation of corporate leaders and activists have decided that it’s actually okay to do so, as long as it leads to their desired outcomes. Quotas over quality. It’s illegal, it’s illogical, and it must stop,” said Gene Hamilton.
